Public Feedback
Having had time to read through this stuff, it confirms what I thought at the time.
The really alarming element is the price BMBC paid; even I can see it is a fraction of what the site would be worth for housing - and that, it seems, would be a justified use.
It seems to me no different to the council taking a shine to that £1m Ming vase in your hall, and asking for that if they’re to recommend approval of someone else’s planning application. In short, bullying because they’ve identified a weakness (your need to proceed or risk losing the option on the Well Lane site).

I thought this, regarding BMBC's very questionable integrity, may be of some interest

We are residents of the Borough and after reading about this on the World Wide Web, we are both ashamed and quite annoyed that our Council could do this. How can anyone in our Borough have any confidence at all in OUR Council, be it on any matter, if they are not prepared to investigate allegations which are supported with the kind of evidence provided by Yorkshire Land. Corrupt comes to mind.

It reads an appalling misuse of the Planning Process by a Local Authority. They have a Statutory Duty to determine PAs in a timely manner and of course to adhere to their own Local Plan, the purpose of which is to promote the development of housing and of course 'affordable' housing... I'm sorry that you have been treated in this way. It really does seem to be quite a shocking manipulation of the process by the Planning Authority

The S106 identifies the Sustainable Travel Contribution. It defines the amount, but not where it should be spent. It just puzzles me how they didn't read the S106 properly before writing/sending the response... especially when it's such a serious matter

The fact you have been through the right channels/sought legal opinion/been stonewalled by the council are all the hallmarks of something worth reporting.
